TERMS AND CONDITIONS

 1. Making a Booking:

  • 1.1. Bookings will be made with oopalley via email, telephone or at our main UK address: 76, Victoria Road, Whitehaven, Cumbria, CA28 6JU.
  • 1.2. A completed booking form showing the names of all persons on whose behalf you are making the booking must be accompanied by a non-refundable deposit of 25% of the total, or proof of payment of said deposit.
  • 1.3. The person who signs the booking form will be treated as doing so on behalf of and with the consent of all the persons for whom the booking is made. That person will be responsible to us for full payment of the price (including any cancellation or alteration charges) of the holiday booked.
  • 1.4. No contract shall exist between you and oopalley until a confirmation of booking showing the arrangements booked has been issued. This will be issued by email but you may request a paper copy.
  • 1.5. The balance owing to oopalley must be paid at least 2 calendar months before arrival. If oopalley does not receive the balance on time we reserve the right to cancel the booking, retain deposit and levy charges as described in section 4.
  • 1.6. If the booking is made within 2 months of arrival, you must pay for the holiday in full.

2. Surcharges:

  • 2.1. Prices are accurate at the date of publication, however we reserve the right to increase or decrease our brochure prices at any time.
  • 2.2. Once you have booked, the price of your holiday is guaranteed, except that surcharges may be applied in the event of changes in exchange rate, legislation, UK or French law, or any other similar event leading to a significant price increase.
  • 2.3. We will absorb amounts up to 2% of the holiday price excluding insurance premiums. Only amounts in excess of 2% will be passed on, and if this means paying more than an increase of 10% of the holiday price you will be entitled to cancel your holiday and obtain a full refund of all money paid, subject to your cancellation being made within 7 days of the notification.
  • 2.4. If payment is made in full on booking, no surcharges will apply.

3. Cancellation or Alteration by Oopalley:

  • 3.1. Oopalley shall endeavor to inform you as quickly as possible of any changes to your booked holiday. We reserve the right to make minor alterations to holiday arrangements without incurring any liability to the client.
  • 3.2. In the unlikely event of oopalley having to make major alterations to or canceling a holiday, we shall offer an alternative or a full refund of all money paid.
  • 3.3. Where cancellation or alteration is in the event of force majeur (e.g. destruction of the property through fire, flood, avalanche, war, or any other circumstance making it impossible for you to stay in the accommodation provided) we will we will notify you as soon as possible and offer you the choice of:

    •  Accepting the modification
    •  Canceling and receiving a full refund
    •  Changing the booking to an alternative holiday - If the alternative is cheaper we will refund the difference, and if it is more expensive you will pay the difference to us

4. Cancellation or Alteration by you:

  • 4.1. Cancellation will only take effect when written notification (by post or email) is received from the person signing the booking form. If cancellation is received in writing prior to 2 months before arrival date the booking deposit will be forfeited. If written notification is received within 2 months of arrival date the following percent charges of total holiday price will apply in addition to loss of deposit:
              • Less than 2 months 40%
              • Less than 6 weeks 60%
              • Less than 4 weeks 80%
              • Less than 2 weeks 100%
  • 4.2. You may request an alteration to the confirmed holiday at any time and we will do our best to help. However it may be beyond our control to action all amendments. An amendment fee of £15 (£30 if within 1 month of arrival) will be charged, plus any additional charges imposed by suppliers of components of your holiday package, where applicable.
  • 4.3. In the event that a long stay (more than 21 days) occupant wishes to cancel, leave early, or is asked to leave as a result of anti social behaviour, a refund may be made pro rata, but only in the event that an alternative occupant can be found, minus any additional costs incurred as a result by oopalley.
  • 4.4. In the event that a short stay (21 days or less) occupant wishes to cancel, leave early, or is asked to leave as a result of anti social behaviour, no refund will be offered.

5. Travel:

  • 5.1. Travel to France requires all British citizens to have a valid full passport. British citizens require no visas. Oopalley cannot be held responsible for clients missing aircraft's, coaches, ferries and trains for whatever reason, and thus being unable to complete their holiday.
  • 5.2. Where Oopalley agree to arrange transfers to and from Geneva airport, you are responsible for informing Oopalley of your arrival/departure time prior to confirmation.

We highly recommend you take out a comprehensive travel insurance policy at the time of final payment, in case you are unable to travel at the last minute (e.g. through illness or injury).

6. Client Responsibility:

  • 6.1. You accept responsibility to conduct yourself and your party in an orderly fashion while on holiday and to not disrupt the enjoyment of others or prejudice the reputation of oopalley. The holiday of any client breaking this clause shall be terminated and oopalley will have no further responsibility to them. You agree that any loss or damage to accommodation or property caused by a client will be recovered immediately and paid in full.
  • 6.2. Oopalley reserves the right to evict you from our accommodation at any time, without notice or refund, e.g. in the event of offensive, illegal, or dangerous behaviour towards us, our associates, the other housemates, the accommodation, or any other party.
  • 6.3. You (and the other occupants) accept responsibility for leaving the accommodation at the end of your stay in the same condition as when you moved in.
  • 6.4. You (and the other occupants) accept responsibility for the safekeeping of your personal possessions as well as the shared items in the property.
  • 6.5. You (and the other occupants) must each provide a security deposit prior to arrival. All security deposits are refundable in accordance with our published schedule, subject to necessary deductions for damages, cleaning or losses in the property. Deductions will be divided equally among all occupants unless one person/group of people admit(s) liability, and will be made pro rata according to the length of your stay.
  • 6.6. Any loss or damages must be reported to oopalley immediately so that we may facilitate replacement or repair. Minor loss or damages (e.g. a broken plate) will normally be considered wear and tear and no charge will be made (subject to the discretion of the owners or the agents acting on their behalf).
  • 6.7. All oopalley properties are non smoking.
  • 6.8. Illegal drugs may not be used or kept in oopalley properties.
  • 6.9. Where a phone line is provided, the exact terms of use will be made clear at the start of your stay. You (and the other occupants) accept joint responsibility for ensuring these terms are followed. Any excess costs will be charged pro rata and equally between occupants.

7. Liability:

  • 7.1. Oopalley cannot be held responsible for or pay any compensation where any loss, delay or costs are caused by war, threat of war, riot, civil strike, industrial dispute, political unrest, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions (including avalanches and mud slides), closure of airports, ports, stations, or roads, and all similar events. This list is by way of example and not by way of limitation.
  • 7.2. Where you do not suffer personal injury or death, oopalley accepts liability should your holiday arrangements booked with us not be as described (without prior notice of change), and not be of a reasonable standard, we will offer alternative arrangements to the same standard or issue discretionary compensation if it affects the enjoyment of your holiday.
  • 7.3. Oopalley (and our associates) do not accept any responsibility for you, anything you do, or anything that happens to you during your stay including your death, injury, illness, or arrest, nor responsibility for the damage to, loss, or theft of your possessions, nor for any damages to property occurring as the result of your (or any other party's) actions.
  • 7.4. Oopalley do not accept responsibility for any accident/injury occurring while skiing/boarding/cycling or participating in any other activity with us (or our associates).
  • 7.5. In the event of medical or other emergency, Oopalley will endeavor to offer you (and your family) all reasonable assistance, support and advice.

8. The Accommodation:

  • 8.1. Accommodation is provided as advertised on our website and detailed in any written offer including all advertised facilities (TV, video, game stations, internet connection etc). However, oopalley do not guarantee to replace these in the event of misuse.
  • 8.2. All linens, duvets and pillows as well as one set of towels are provided in all our accommodation unless otherwise agreed. Fresh linens will be provided bi-weekly and towels weekly.
  • 8.3. Oopalley agrees to arrange regular cleaning of the communal properties (and other properties at extra cost if requested). This is agreed on the proviso that the properties remain in a reasonably clean and tidy condition which you (and the other occupants) accept responsibility for. Any costs over and above the norm will be charged accordingly.
  • 8.4. Oopalley and its associates may enter the properties at any time without notice and will check the properties condition and contents regularly during the season to ensure all remains in good condition for your safety and comfort.

9. Insurance:

  • 9.1. You are responsible for organising your own travel insurance for the duration of your stay, including cover of any personal possessions and any activities you may participate in. You are responsible for providing the details of your travel insurance to oopalley.
  • 9.2. It is your responsibility to ensure that your travel insurance covers the cost or part cost of your stay in the event of you leaving through illness, injury or any other reason. In the event of illness or injury, oopalley will take all reasonable steps to provide advice, support, and confirmation of your booking to any party reasonably requiring it.
  • 9.3. We will ask you to let us have evidence of the insurance at least six weeks prior to departure or at the time of booking if later. We reserve the right to terminate your booking if you fail to obtain travel insurance cover.

10. Complaints:

  • 10.1. It is our aim to settle any complaints amicably and quickly. Should you have any problems whilst on holiday, our local representatives should be informed so that action can be taken without delay. If you wish to pursue a claim against us, written notification must be given to us no later than 28 days after the end of your holiday.
  • 10.2. If you have a dispute with oopalley that cannot be resolved amicably, you may call upon a scheme administered by the Chartered Institute of Arbitrators.

11. Exchange rates:

  • 11.1. On any occasion where it is necessary to convert between sterling & euros, the mean average exchange rate to 2 dp for the previous month displayed on www.x-rates.com (or similar) will be used.

12. Other Information:

  • 12.1 The descriptions contained in this brochure and all other information supplied by oopalley is correct to the best of our knowledge. However, although the accuracy is not guaranteed, all descriptions and information are given in good faith and in the belief that they were true at the time of printing.
  • 12.2. Oopalley may occasionally use photos or images on our website or in our advertising material that are not of the resorts or properties in our programme. Unless otherwise specified by you, any photos of you taken during your stay may be used by oopalley on our website or in advertising or promotional material.

13. Jurisdiction:

  • 13.1 The conditions and any contract to which they apply are governed in all respects by English Law.
